Welcome to Brstain. These Terms & Conditions govern your use of this website and any engagement with our brand strategy services, including the BRANDPRINT methodology. By accessing brstain.com, requesting a diagnostic session, or entering into a service agreement with Brstain, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree, please do not use this website or engage our services.
Brstain provides brand strategy consulting and creative services, including but not limited to: the BRANDPRINT methodology (Foundation, Rebuild, and Activate versions), brand identity and visual design, naming and brand architecture, digital communication platform development, content strategy and copywriting, web strategy, packaging design, and print production management. Services are delivered under the specific scope, timeline, and deliverables agreed upon in a signed service proposal or contract. Brstain reserves the right to decline or discontinue any engagement that conflicts with our values or operational capacity.
The BRANDPRINT name, methodology, frameworks, processes, and all associated documentation are the exclusive intellectual property of Brstain. All content published on this website — including text, graphics, visual systems, and case studies — is protected under applicable copyright and intellectual property law. You may not reproduce, distribute, adapt, or create derivative works from any Brstain content without prior written consent. Upon full payment of a service engagement, the client receives ownership of the final deliverables produced specifically for them. Brstain retains the right to use anonymized versions of client work as portfolio references unless explicitly agreed otherwise in writing.
All BRANDPRINT engagements require a signed proposal and an initial deposit before work begins. Payment schedules, milestones, and final delivery terms are specified in each individual service agreement. Brstain will not initiate work without written confirmation of scope and payment terms. Late payments may result in suspension of services. Deliverables are considered accepted if no written objection is received within 5 business days of delivery. Refunds are not issued for work already delivered or for client delays that extend the engagement timeline beyond the agreed period.
Brstain treats all client information shared during any engagement — including business data, market insights, internal strategies, and financial information — as strictly confidential. We will not disclose this information to third parties without your written consent, except as required by law. Clients are similarly expected to treat Brstain's proprietary frameworks, working documents, and methodology details as confidential and not share them with competing service providers. This obligation survives the termination of any service agreement.
Brstain's services are strategic and advisory in nature. While we apply 20+ years of expertise and a proven methodology to every engagement, we cannot guarantee specific business outcomes such as revenue growth, market share gains, or sales conversions — as these depend on factors outside our control, including client execution, market conditions, and competitive dynamics. Brstain shall not be liable for any indirect, consequential, incidental, or punitive damages arising from the use of our services or website. Our total liability in any engagement is limited to the fees paid for the specific service in question.
These Terms & Conditions are governed by the laws of the United Mexican States (México). Any disputes arising from the use of this website or our services shall be subject to the exclusive jurisdiction of the competent courts in Tijuana, Baja California, México.
